Notion of working day – exceptions regarding labor law, social security and social welfare

In our CLI from 22 October 2022, we informed you that, following the entry into force of article 1.7 of the new Civil Code, Saturdays were no longer to be considered as working days. This was a change with enormous implications, especially with regard to periods of notice in labour contracts.
 
However, the Belgian legislator decided to reverse this change by adopting the law of 26 December 2022, with the objective of neutralizing article 1.7 of Book 1 of the Civil Code, regarding labor law, social security and social welfare.
 
As a result of the entry into force of this law on 1 January 2023, Saturdays are once again to be considered working days for the purposes of dismissal.
