Indexation of commercial rents

Since 22 December 2022 (Ordinance of the Brussels Region of 15 December 2022) the indexation of commercial rents is being limited in the Brussels-Capital Region.

This proposal is part of the support measures for companies suffering from the energy crisis.

Landlords can still index the rent in commercial leases but only on the basis of a reduced consumer price index, from which most energy components, i.e. electricity, natural gas, butane, propane, liquid fuels, solid fuels and motor fuels, have been taken out of.

This measure is currently being enforced for a year as of 22 December 2022 and on average make it possible to reduce the indexation by half in the Brussels-Capital Region

In Flanders, the idea of tying rent indexation to  EPB (Energy Performance of Buildings) certification even for commercial leases is currently being discussed (to date nothing has been decided on this matter for the moment)
