Restructuring and Insolvency

Cairn Legal frequently acts to prevent and resolve all issues involving firms in difficulty.

A company experiencing financial problems faces many internal and external problems that require the intervention of external advisers. Such problems can only be resolved through a multidisciplinary approach that Cairn Legal is able to provide: Company Law, Banking Law, Industrial Relations Law, Civil Proceedings Law, etc. Because these are specialty areas, Cairn Legal can adopt a particularly effective and pragmatic approach. Our attorneys act as advisers to firms experiencing problems, to their creditors and bankruptcy administrators.

Cairn Legal assists its clients at the first warning sign and helps with the decisions to be taken. It advises the company experiencing problems in its relationships with its creditors, especially banks; with its employees and, if applicable, with the commercial court. It plays an active role in the definition and implementation of legal, financial and operational restructurings required by the situation. If necessary, it initiates appropriate proceedings, such as composition with creditors, liquidation or filing for bankruptcy and assists the firm until these proceedings have come to a conclusion.
