New Standard Contractual Clauses (SCCs)

Standard Contractual Clauses (SCCs) are model contracts for the transfer of personal data adopted by the European Commission. The standard contractual clauses have recently been updated by the European Commission following the “Schrems II” decision rendered by the Court of Justice of the European Union.

As of 27 September 2021, the old SCCs are abrogated and it is compulsory to use the new SCCs. For transfers already covered by the old SCCs, data importers and exporters have been awarded an extension until 27 December 2022 in order to fall in line, provided that no substantial changes to the contract take place in the meantime and that they ensure that the transferred data are subject to appropriate safeguards.
