Extension of exceptional measures regarding condominiums’ General Assembly meetings

The law of 20 December 2020 offered the possibility for condominium trustees to postpone ordinary General Assembly meetings for one year, i.e. until the date provided for in the statutes. In order to ensure the continuity of condominiums, all mandates of trustees, board members and auditors were automatically extended.

The law also allowed the use, even for written votes, of the usual majority rules usually provided for by the law regarding condominiums (absolute majority in principle and qualified majority if specified in the statutes). These measures were supposed to end on 9 March 2021.

However, the government has decided to extend them until 30 June 2021 (The Royal Decree confirming this extension of validity should be published within the next few days in the Belgian Official Journal).

We would also like to remind you that the law of 20 December 2020 also allowed for virtual or remote General Assembly meetings to take place, under the condition that the convocation issued by the trustee provided for it. This measure is not time-limited.
