A lawyer can countersign your agreement and increase its probative value

On 3 June 2013, the Act of 29 April 2013 on the private deed countersigned by parties’ lawyers was published in the Belgian Gazette.

This act provides for the possibility for parties to have their agreements countersigned by their lawyer.

This is intended to increase the probative value of the private deed. The scope of this increased evidence value concerns in particular the evidence of the existence of the deed signed by the parties involved it.

According to the preparatory works, the aim of this act is to reduce the risk of future dispute. According to article 3 of the act, lawyers who countersign agreements bear the obligation to fully inform the parties of the legal consequences of the act.
